Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you and Stackr Technologies, Inc. ("Stackr," "we," "us," or "our") governing your use of the Stackr financial planning service, including our website, mobile applications, and any associated software or services (collectively, the "Service").

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

Stackr is a personal financial planning platform that helps individuals and households aggregate financial account data, track spending, plan goals, and receive AI-powered insights. The Service includes:

• Read-only connection to financial institutions via Plaid
• Budget tracking, goal planning, retirement projection, and tax estimation tools
• AI-powered financial coaching and Q&A
• Alerts and notifications about your financial accounts
• Secure document storage and organization

The Service is provided on a subscription basis. Feature availability depends on your subscription plan as described on our pricing page.

To use Stackr, you must:

• Be at least 18 years of age
• Be a legal resident of the United States
• Have the legal capacity to enter into a binding contract
• Not be prohibited from using the Service under applicable law

By using the Service, you represent and warrant that you meet all eligibility requirements. We may terminate your access if we discover you do not meet these requirements.

The projections, estimates, calculations, and AI-generated responses provided by Stackr are for informational and planning purposes only. They are based on information you provide and publicly available data, and may not account for all factors relevant to your situation.

You should not make financial decisions — including decisions about investments, retirement, debt repayment, tax filing, or insurance — based solely on information from Stackr. We strongly recommend consulting with a qualified financial advisor, tax professional, or attorney before making significant financial decisions.

Stackr does not execute trades, initiate transfers, file taxes, or take any action with respect to your finances. All account connections are read-only.

Stackr uses Plaid Technologies, Inc. to connect your financial accounts. By connecting accounts, you agree to Plaid's Terms of Service ↗ and Privacy Policy ↗.

Stackr also uses Anthropic's AI models to power the financial coach feature. Content you submit to the AI assistant may be processed by Anthropic in accordance with their Privacy Policy ↗.

We are not responsible for the availability, accuracy, or actions of third-party services. Disruptions to Plaid or other providers may affect Service functionality.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable law
• Attempt to gain unauthorized access to any part of the Service or another user's account
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated scripts, bots, or scrapers to access or collect data from the Service
• Interfere with or disrupt the Service or its infrastructure
• Upload malicious code, viruses, or harmful content
• Impersonate any person or entity or misrepresent your affiliation
• Use the Service to provide services to third parties without our written consent
• Resell, sublicense, or commercially exploit the Service without authorization

We reserve the right to suspend or terminate your account immediately if you violate these restrictions.

Our collection and use of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

You are responsible for the accuracy of the information you provide. We process your financial data as a service provider — we do not own your data and will not use it for purposes beyond providing and improving the Service.

You may request a complete export of your data or deletion of your account at any time by contacting us at legal@stackr.app.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Financial data from connected accounts will be complete, accurate, or current
• Projections, estimates, or AI-generated content will be accurate or suitable for your situation
• Any errors or defects will be corrected

Account balances and transaction data depend on third-party providers. We are not responsible for inaccuracies originating from your financial institutions or Plaid.

IN NO EVENT WILL STACKR BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, BUSINESS, OR GOODWILL, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to defend, indemnify, and hold harmless Stackr Technologies, Inc. and its officers, directors, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you submit to or through the Service

These Terms are governed by the laws of the State of Delaware, without regard to its conflict of law provisions.

Any dispute arising from these Terms or your use of the Service will be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, rather than in court, except that either party may seek injunctive or other equitable relief in court for intellectual property violations.

You waive any right to participate in a class action lawsuit or class-wide arbitration.

We may modify these Terms at any time. For material changes, we will provide at least 30 days' notice by:

• Sending an email to your registered address
• Displaying a notice in the application
• Updating the effective date above

Your continued use of the Service after changes take effect constitutes acceptance. If you do not agree to the updated Terms, you must stop using the Service and may cancel your account for a pro-rated refund of any prepaid fees.
